Terms of Service

These Terms of Service apply to purchases made through online stores and websites operated by Njom Foods OÜ, including the domains njomfoods.com, njom.ee, njomfoods.eu, njomfoods.lt, njom.lt, and any other domains used by Njom Foods OÜ.

1. Validity of the Terms

These Terms of Service apply to the purchase of goods from the online stores of Njom Foods OÜ.

In addition to these terms, the legal relationships arising from purchases made in the online store are governed by the laws of the Republic of Estonia and the European Union.

Njom Foods OÜ reserves the right to amend these Terms of Service. Any changes will be published in the online store and will take effect upon publication, unless stated otherwise.

2. Product Prices

The prices of products sold in the online store are displayed next to the products.

All prices are in euros and include VAT, unless stated otherwise.

A delivery fee is added to the price unless the order meets the conditions for free delivery.

The delivery fee depends on the customer’s location, the weight of the order and the selected delivery method. The delivery cost is displayed in the shopping cart before the order is confirmed.

Njom Foods OÜ reserves the right to change prices, campaigns and delivery methods. The price applicable to the order is the price displayed at the time the order is placed.

3. Placing an Order

To place an order, the customer must add the desired products to the shopping cart, enter the required contact and delivery details, choose a delivery method and pay for the order.

The customer is responsible for ensuring that the contact and delivery details provided are correct. The customer is responsible for any delays, additional costs or failed delivery caused by incorrect or incomplete information.

The order is considered confirmed after successful receipt of payment.

4. Payment Methods

The online store accepts the payment methods displayed at checkout.

Payments are processed by Maksekeskus / MakeCommerce.

Available payment methods may include:

  • bank links;
  • card payments;
  • Apple Pay;
  • Google Pay;
  • other payment methods displayed in the online store.

Njom Foods OÜ does not process or store the customer’s full payment card details.

5. Delivery

We deliver orders to Estonia, Latvia and Lithuania.

Available delivery methods include:

  • DPD parcel locker;
  • Smartpost parcel locker;
  • Smartpost courier;
  • other delivery methods displayed in the online store.

The usual delivery time is 2–5 business days from order confirmation.

In special cases, delivery may take longer, for example due to delays by the delivery partner, lost parcels, major campaign periods, public holidays, weather conditions or other circumstances beyond the control of Njom Foods OÜ.

The delivery fee is displayed in the shopping cart before the order is confirmed. The online store may offer free delivery when certain purchase amount, campaign, weight or other conditions are met.

The parcel locker delivery fee is calculated for every started 11 kg. If the order weight exceeds 11 kg, the order may be divided into several shipments, and an additional delivery fee may be added for every started 11 kg according to the conditions displayed in the online store.

Free parcel locker delivery applies if the order meets the free delivery purchase amount condition and the order weight does not exceed 11 kg. If the free delivery condition is met but the order weight exceeds 11 kg, an additional fee may apply for each next started 11 kg shipment.

If a parcel is returned to Njom Foods OÜ due to an incorrect address, failure to collect the parcel or customer inactivity, resending the order may be at the customer’s expense.

If the order contains frozen products or products requiring special delivery conditions, delivery may be made using a separate delivery method, separate shipment or within a limited delivery area.

6. Product Availability

If an ordered product cannot be delivered, we will contact the customer and, where possible, offer a replacement product, later delivery or refund the relevant amount.

Njom Foods OÜ is not responsible if a product is temporarily out of stock, but will make reasonable efforts to inform the customer as soon as possible.

7. Campaigns and Discount Codes

Campaigns, discounts and discount codes are valid during the period and under the conditions stated in the campaign terms.

Unless stated otherwise, different discount codes and campaigns cannot be combined.

Njom Foods OÜ reserves the right to end a campaign or amend its conditions in the event of a technical error, misuse or another valid reason.

8. Right of Withdrawal and Returns

Consumers generally have the right to withdraw from a distance contract within 14 days from receiving the goods.

To withdraw from the contract, the customer must send a clear statement to info@njomfoods.com.

Returned goods must be unused, unopened, in their original packaging and in the same condition as received.

The 14-day right of withdrawal does not apply to products that cannot be returned due to their nature.

This includes, among others:

  • perishable products;
  • frozen or cold-chain products, if their shelf life or food safety cannot be guaranteed after delivery to the customer;
  • food products with opened packaging;
  • products that are not suitable for return due to health protection or hygiene reasons, if the packaging has been opened;
  • products that have been used, damaged or stored contrary to the manufacturer’s instructions.

The direct cost of returning the goods is borne by the customer, except where the return is due to an incorrect, defective or damaged product.

9. Complaints and Defective Goods

If the goods are damaged, incorrect or defective, please notify us as soon as possible at info@njomfoods.com.

Please include the following in your email:

  • order number;
  • name of the damaged or incorrect product;
  • description of the issue;
  • photos of the product, packaging and transport packaging.

We will review the complaint within a reasonable time and, where necessary, replace the product, refund the payment or offer another suitable solution.

10. Liability

Njom Foods OÜ is responsible for the conformity of the products sold to the customer in accordance with applicable legislation.

Njom Foods OÜ is not responsible for damage caused by incorrect information provided by the customer, improper storage of products, incorrect use of products or customer inactivity.

The customer is responsible for ensuring that products are stored and used according to the instructions provided on the packaging.

11. Processing of Personal Data

Njom Foods OÜ processes the customer’s personal data in accordance with the Privacy Policy.

12. Dispute Resolution

If the customer has a complaint regarding the online store, it must be sent to info@njomfoods.com.

If the customer and Njom Foods OÜ are unable to reach an agreement, the consumer has the right to contact the Consumer Disputes Committee.

The consumer also has the right to protect their rights by contacting a competent court or another competent supervisory authority.
